This license ("License") is a legal agreement between you ("Licensee," "you," or "your") and Kiilstofte Music Inc., Canada ("Licensor," "we," "us," or "our") governing your use of music, sound recordings, and associated audio content ("Content") made available through Machinimasound.com ("Website").
By downloading, streaming, or otherwise using any Content from the Website, you agree to be bound by the terms of this License. If you do not agree, you may not use the Content.
Scope
This License applies to all Content published on the Website except tracks designated as "Legacy Tracks." Legacy Tracks were originally released under the Creative Commons Attribution 4.0 International (CC-BY 4.0) license and remain governed by that license. The terms of this License do not apply to Legacy Tracks and do not modify, supersede, or revoke the CC-BY 4.0 license under which they were released.
1. Grant of License
Subject to the terms and conditions of this License, the Licensor grants you a non-exclusive, worldwide, irrevocable license to use the Content in personal and commercial projects, including but not limited to video content, podcasts, games, applications, and online media, provided that you comply with the attribution requirements set forth in Section 2.
A single download of Content may be used across multiple platforms and projects, provided each use complies with the terms of this License. No separate license is required per platform.
This License is granted at no cost. No license fee or per-use royalty is owed directly to the Licensor for uses permitted under this License.
2. Attribution Requirements
2(a) General Attribution
You must provide credit for each piece of Content used, including the track title, "Machinimasound," and a link to https://machinimasound.com, in a reasonable manner appropriate to the medium, means, and context in which the Content is used. Examples of appropriate placement include but are not limited to: video descriptions, end credits, liner notes, in-app credits screens, show notes, or accompanying text.
The following format is recommended but not strictly required, provided the three elements above are present:

Attribution is not optional. It is a condition of this License. Failure to provide attribution constitutes a breach of this License. See Section 5.
2(b) Live Streaming
For live broadcasts (e.g., Twitch, YouTube Live, or similar), per-track attribution is not required during the live broadcast itself. Instead, a general credit in a persistent, publicly accessible location on the streaming channel (such as an "About" panel, channel description, or equivalent) is sufficient, provided it includes "Machinimasound" and a link to https://machinimasound.com.
If the live broadcast is later published as a video-on-demand recording, the standard attribution requirements in Section 2(a) apply to that recording.
2(c) Content Identification
The Licensor uses automated content identification systems (such as YouTube Content ID) to manage unauthorized use of the Content. Videos and other media that include the required attribution — specifically, a reference to "Machinimasound," "Per Kiilstofte," or a link to machinimasound.com — are automatically excluded from content claims or have claims released without manual intervention.
Proper attribution is therefore not only a condition of this License but also the mechanism by which licensees avoid content claims on their work. If you receive a content claim on material used under this License, verify that your attribution is present and correctly formatted. For claim inquiries, contact [email protected].
3. Permitted Uses
Under this License, you may:
(a) Use the Content in personal, non-commercial projects.
(b) Use the Content in commercial projects such as monetized video content, podcasts, games, applications, and online media.
(c) Edit, cut, loop, or otherwise adapt the Content to fit your project, provided the Content is used as part of a larger work and not presented as a standalone musical release.
4. Restricted Uses
This License does not grant rights for the following uses, which require a separate written license agreement from the Licensor:
(a) Broadcast and Traditional Media. Use of the Content in television broadcasts, radio broadcasts, film, streaming platform originals (e.g., Netflix, Amazon, Disney+, Hulu, Apple TV+, or similar), cinema releases, theatrical productions, or any form of traditional broadcast media.
(b) Redistribution. Sharing, sublicensing, reselling, or otherwise redistributing the Content, whether in its original or modified form, as a standalone audio file or as part of any music library, sample pack, sound collection, or similar product.
(c) AI and Machine Learning. Using the Content as training data, input, or reference material for machine learning models, artificial intelligence systems, neural networks, or any similar automated systems.
(d) Standalone Release. Releasing the Content, whether in its original or modified form, as your own musical work on streaming platforms, download stores, or any other music distribution channel.
(e) Misrepresentation of Authorship. Claiming authorship or ownership of the Content, registering the Content with any rights organization, or filing Content ID or similar claims against the Content.

5. Termination and Cure
5(a) Termination
This License is granted for the duration of the underlying copyright and is not revocable at will. However, this License will terminate automatically and immediately if you:
(i) Use the Content in any manner described as restricted under Section 4 without a separate written license;
(ii) Use the Content in connection with content that is unlawful, defamatory, hateful, promotes violence or discrimination, or is otherwise objectionable in a manner that infringes the Licensor's moral rights or brings the Licensor or the Content into disrepute, as determined at the Licensor's sole discretion; or
(iii) Otherwise breach any term of this License not subject to the cure provision in Section 5(b).
5(b) Cure Period for Attribution Breaches
If the breach consists solely of a failure to provide attribution as required by Section 2, the Licensee's rights under this License are reinstated automatically, provided the Licensee cures the breach within thirty (30) days of discovering the breach or receiving written notice of it from the Licensor, whichever occurs first. This cure provision may be exercised only once per Licensee. A second attribution breach by the same Licensee terminates this License immediately without a further cure period.
For the avoidance of doubt, this Section 5(b) does not affect any right the Licensor may have to seek remedies for violations that occurred during the period of non-compliance.
5(c) Post-Termination
Upon termination under Section 5(a), the Licensee will be notified in writing (including via email). From the date of notification, the Licensee has thirty (30) days to either:
(i) Remove or disable all works incorporating the affected Content; or
(ii) Contact the Licensor at [email protected] to negotiate a paid license for continued use.
If the Licensee fails to take either action within the thirty-day period, any continued use of the Content constitutes copyright infringement and unauthorized use, and the Licensor reserves all rights and remedies available under applicable law, including but not limited to Content ID claims, takedown requests, and claims for damages.
6. Intellectual Property
All Content remains the exclusive property of the Licensor. This License does not transfer any ownership, copyright, or intellectual property rights to the Licensee. All rights not expressly granted in this License are reserved by the Licensor.
7. No Warranty
The Content is provided "as is" without warranty of any kind, express or implied, including but not limited to the warranties of merchantability and fitness for a particular purpose.
8. Limitation of Liability
To the fullest extent permitted by law, in no event shall the Licensor be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of or inability to use the Content, whether based on warranty, contract, tort (including negligence), or any other legal theory.
9. Governing Law
This License shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.
10. Changes to This License
The Licensor reserves the right to modify this License at any time. Updated versions will be posted on the Website with a new version number and date. Content downloaded or used under a previous version of this License remains perpetually subject to the terms of that version, provided the Licensee was in compliance with that version at the time of download and remains in compliance thereafter. A subsequent version of this License does not retroactively alter, revoke, or impose additional conditions on uses already in production under a prior version.
